As a condition of your use of the Site, you agree that you will not, and you will not take any action intended to: (i) access data that is not intended for you; (ii) invade the privacy of, obtain the identity of, or obtain any personal information about any Tally client or user of the Site; (iii) probe, scan or test the vulnerability of the Site or the Tally network or breach security or authentication measures without proper authorization; (iv) attempt to interfere with service to any user, host or network or otherwise attempt to disrupt our business, including by means of submitting a virus to the Site, overloading, "flooding," "spamming," "mail bombing" or "crashing;" or (v) send unsolicited mail, including promotions and/or advertising of products and services. If you violate our system or network security, it could result in civil or criminal liability to you.
BY USING THE SERVICE YOU AGREE NOT TO:

Perform any fraudulent activity including impersonating any person or entity, claiming false affiliations, accessing the accounts of others without permission, or falsifying your age or date of birth;
Sell or otherwise transfer Service access or any Service-related content or any right or ability to view, access, or use any Service-related content or materials;
- Provide Financial Information to us which you do not have the authority to provide;
Open more than one Tally account;
- Use the Feature to make payments to anyone outside the United States or its territories, make payments to unlawful Internet gambling sites, make payment to or at the direction of any government agency or entity, or make any court-ordered payments;
- Attempt to do any prohibited conduct, or assist or permit any persons in engaging or attempting to engage in any prohibited conduct.
Termination of Use; Discontinuation and Modification of the Service
If you violate any provision of these terms, your permission to use the Service will terminate automatically. Additionally, we, in our sole discretion may terminate your user account on the Service or suspend or terminate your access to the Service at any time, with or without notice. We also reserve the right to modify or discontinue the Service at any time (including by limiting or discontinuing certain features of the Service) without notice to you. We will have no liability whatsoever on account of any change to the Service or any suspension or termination of your access to or use of the Service. You may terminate your account at any time by contacting customer service at firstname.lastname@example.org. If you or we terminate your account, you will remain obligated to pay all outstanding amounts owed to us or on your line of credit, if any, relating to your use of the Service incurred prior to termination.

We are not responsible for examining or evaluating, and we do not warrant the offering of these services and resources or the content of their web sites. Tally does not assume any responsibility or liability for the actions, products, and content of these and any other persons. Any failure by Tally to exercise any rights or enforce any of these terms is not a waiver of such rights or terms. If any provision of these Terms or their application in a particular circumstance is held to be invalid or unenforceable to any extent, the remainder of these Terms, or the application of such provision in other circumstances, will not be affected, and each provision will be valid and enforced to the fullest extent permitted by law.
To the extent permitted by applicable law, (i) these terms will be governed by the laws of the State of California without regard to conflict of law principles, and (ii) to the extent that any lawsuit or court proceeding is permitted under these terms, we both agree to submit to the personal and exclusive jurisdiction of the state courts and federal courts located within San Francisco County, California for the purpose of litigating all such disputes.
Information We Collect
We collect Personal Information from everyone who uses our Service. We collect this information at various stages of your experience with us. We collect basic information such as name and email address when you open an account, and we ask for more detailed information such as financial information as you seek loans using our platform.
We may collect information from you as you use our Service. When you choose to create an account, we ask for your name, phone number, email address, home address, date of birth, Social Security number. We may also collect, as noted below, cookies and other browsing data. You may choose to provide additional, optional information such as your location or information required to share content on your social media accounts. During the loan application process, we may also request financial information such as username and password for your bank account, account balance, transaction history, ACH authorization, or credit report.
You can decline to provide additional Personal Information, or through your browser, block or delete cookies, but doing so may prevent you from engaging with and using certain parts of the Service.
Cookies and Automatic Data Collection
As you use our Service, we and our service providers may collect browsing information about you, such as location, internet protocol (IP) address, browser type, referral source, and other information from server logs, cookies, or similar technology. We may obtain information from your mobile or tablet device, such as device type, location, IP, language setting, or browser type. In addition, when you contact our customer support team, we may collect information from you through those communications. Most browsers allow you to block and delete cookies. However, if you do that, the Service may not work properly.

Tally does not allow minors (persons under age 18) to register for or use Tally Services. If you use the Service, you represent and warrant that you are at least 18 years of age. Tally and the Tally Site does not target minors as an audience or a market. If we learn that we have inadvertently collected personal information from a minor, we will make all reasonable efforts to delete that data from our records.
Mobile Device Usage
Use of the Service may be made available through a browser on a mobile device or through an application running on a mobile device. You are responsible for all costs incurred by you with respect to using the Service on a mobile device, including data usage fees and other telecommunications fees.
How We Use Your Information
e use this information to help us verify your identity, communicate with you, prevent fraud, originate your loan, service your loan, help you refer friends to our Service, and in other ways not prohibited by applicable law . Tally may use your information, including Personal Information in order to perform our Services including for the following activities:
Identity Verification and Security
- Confirm that you are over the age of 18.
- Verify your identity and safeguard against potential fraud.
- Protect data from unauthorized parties and comply with legal requirements.
Underwriting and Funding Loan
- Pull a credit report from a credit bureau to help establish creditworthiness.
- Determine your eligibility for a loan as part of the underwriting process.
- Send information about you as a borrower to investors who we may transact with regarding your loan.
- Enable our service providers to implement automatic payments and fund transfers.
- Communicate with you if there is a problem completing a transaction you requested or to discuss a problem with your account.
- Implement collection activities as needed.
- Maintain regular communications with you concerning transactions you initiate, such as requesting information or assistance, submitting a loan request, making payments, or transferring funds.
- With your consent, send you a text message or in-app notifications regarding certain aspects of our Service. You can revoke this consent at any time.
- Access social media.
- Help you refer friends directly from within the app or website.
- With your consent, help you link your device phonebook to easily share Tally with your friends. You can revoke this consent at any time.
Tally will never advertise or sell your Personal Information to a third party. We may anonymize and aggregate data collected through the Service and use it for any purpose.

We may share your information, including Personal Information, for a number of reasons: with our service providers to facilitate our Service; with social networks, at your direction; to comply with legal obligations; to protect and defend our rights and property; and for any other reason with your permission.
We work with a range of service providers who provide functionality to our Service. We may share information, within the limits of applicable law, with vendors and service providers to help us provide our Service.
