Thank you for your interest in Tally Technologies, Inc. (“Tally,” “we,” or “us”). Your privacy is very important to us. We welcome you to our Website at www.meettally.com as well as all related websites, downloadable software, mobile and tablet applications (the “Site”), and products and services provided by us and under Tally’s control (collectively, together with the Site, our “Service”). 

As you use our Service, you may provide us with information about you, including information that can be used to identify you. This Privacy Policy explains how Tally may collect, use, and disclose information you provide us and other information we receive related to your use of the Service. Your use of the Service constitutes agreement to the terms in this Privacy Policy, which is incorporated by reference in our Terms and Conditions.

By accessing or using the Service or the Site, you acknowledge that you have read, understood, and agree to the terms of this privacy policy (“Privacy Policy”). What Information We Collect & Why

When we use "Personal Information" in this Privacy Policy, we mean information that—alone or in combination with other information—could be used to readily identify, contact, or locate you, such as: name, address, email address, date of birth, home address, telephone number, and other information. We do not consider information to be Personal Information if it has been anonymized so that it does not allow Tally or a third party to easily identify a specific person.

When we use “Sensitive Personal Information” in this Privacy Policy, we mean Personal Information that reveals Social Security number, account log-in in combination with any required credentials that allow access to the account, precise geolocation, biometric or genetic information, health information, or other information that is treated as sensitive in nature.

We collect Personal Information from everyone who uses our Service. We collect this information at various stages of your experience with us. We collect basic information such as name and email address when you open an account, and we ask for more detailed information such as financial information as you seek a loan from us. When you choose to create an account, we may ask for your name, phone number, email address, home address, income, and date of birth, depending on which part of the Service you wish to use. We may also collect, as noted below, cookies and other browsing information about you. We may also request financial information such as your bank account, account balance, transaction history, ACH authorization, or credit report in order to facilitate your use of the Service.

We also collect Sensitive Personal Information from everyone who uses our Service.  When you choose to create an account, we may ask you for your Social Security number, depending on which part of the Service you wish to use.  We may also request account information, such as username and password for your bank account, in order to facilitate your use of the Service.

You can decline to provide additional Personal Information or Sensitive Personal Information but doing so may prevent you from engaging with and using certain parts of the Service.

How We Use Your Information

We use the collected Personal Information to help us verify your identity, communicate with you, prevent fraud, learn what parts of the Service you are qualified to use, if necessary, originate your loan, service your account, help you refer friends to our Service, and in other ways not prohibited by applicable law. We also use this information to provide you with relevant content, and more generally, to facilitate and improve the Service. 

Tally may use your information, including Personal Information provided by you or from service providers, to perform the Service including for the following activities:

Identity Verification and Security

  • Confirm that you are at least 18 years old (or older if you live in a state where the age of majority is older than 18, if applicable).

  • Verify your identity and safeguard against potential fraud.

  • Protect data from unauthorized parties and comply with legal requirements.

Underwriting and Qualifications for the Service

  • Pull a credit report from a credit bureau to help establish qualifications for the Service.

  • Determine your eligibility for a loan as part of the underwriting process.

  • Send information about you as a borrower to investors who we may transact with regarding your loan.

Servicing

  • Enable our service providers to implement automatic payments and fund transfers.

  • Communicate with you if there is a problem completing a transaction you requested or to discuss a problem with your account.

  • Implement collection activities as needed.

  • Maintain regular communications with you concerning transactions you initiate, such as requesting information or assistance, submitting a loan request, making payments, or transferring funds.

General Communications

  • With your consent, send you a text message or in-app notifications regarding certain aspects of our Service. You can revoke this consent at any time. 

Referral Activities

  • Help you refer friends directly from within the Site.

  • With your consent, refer you to third parties (e.g., other lenders) who may be able to help you. 

  • With your consent, help you link your device phonebook to easily share Tally with your friends. You can revoke this consent at any time.

How We May Disclose Your Information

We may share your information, including Personal Information and Sensitive Personal Information, for a number of reasons: with our service providers to facilitate our Service; with Cross River Bank for those lines of credit offered/issued by them; with social networks, at your direction; to comply with legal obligations; to protect and defend our rights and property; and for any other reason with your permission. We may also share your Personal Information and Sensitive Personal Information for the following reasons:

  • We work with a range of service providers who provide functionality to our Service. We may share information, within the limits of applicable law, with service providers to help us provide our Service. You acknowledge and agree that your data and information will be treated in accordance with third-party data providers' privacy policies such as https://plaid.com/legal/ and https://www.finicity.com/privacy/. We may share information and also, with your permission, share your Personal Information with social networking websites and other website services.

  • From time to time, Tally may have to access, preserve, or disclose your Personal Information or Sensitive Personal Information or other information in accord with applicable law. Tally will comply with law enforcement requests, administrative proceedings, and legal processes to protect the rights, property, or safety of you, of us, or of others.

  • We may share information if we believe it is necessary to detect, investigate, prevent, or take action against illegal activities or fraud.

  • If we are involved in a merger, acquisition, financing due diligence, reorganization, bankruptcy, receivership, sale of assets, or transition of service to another provider, your information, including Personal Information, may be sold or transferred as part of such a transaction as permitted by law and/or contract. We cannot control how such entities may use or disclose such information. 

  • We may share your Personal Information and Sensitive Personal Information, as appropriate to carry out any other legitimate business purpose allowed by law.

By signing up for the Service, you consent to the disclosure to nonaffiliated third parties of nonpublic Personal Information pertaining to you. This consent is effective until you revoke it. You can revoke this consent at any time by emailing us at contact@meettally.com with "Privacy" in the subject line. You may want to review, download, or print a copy of this consent for your records. You are entitled to do so at any time by visiting our Site.

Third-Party Sites and Services

When logging into a third-party service (such as a social network) or a website different from our Service, please be aware that the privacy practices of those services may differ. Use of the information will be governed by their privacy policies, and you may be able to modify your privacy settings on their websites. We encourage you to read the privacy policy for each website you visit. We are not responsible for the privacy policies or practices of third party sites or services that are linked from our Site.

Our Site may also contain embedded applications, widgets, or social media plug-ins, such as Facebook, Twitter, and LinkedIn.

Cookies and Automatic Data Collection

As you use our Service, we and our service providers may collect browsing information about you, such as location, internet protocol (IP) address, browser type, referral source, and other information from server logs, cookies, or similar technology. We may obtain information from your mobile or tablet device, such as device type, location, IP address, language setting, or browser type. In addition, when you contact our customer support team, we may collect information from you through those communications. Most browsers allow you to block and delete cookies. However, if you do that, the Service may not work properly.

Analytics Services

We may allow third parties to collect information about the users of our Site. Such third parties may collect Personal Information about your online activities over time and across different websites when you use our Site.  We do not control these third parties, who may engage in practices that differ from those described in this Privacy Policy. 

For example, the Site uses Google Analytics, a web analytics service provided by Google, Inc. (“Google”). Google Analytics may set cookies on your browser or mobile device or read cookies that are already there to collect information. Google Analytics may also receive information about you from apps you have downloaded that partner with Google. Google Analytics collects information such as how often you use the Site and how you use the Site. We use the information provided by Google Analytics to improve the Site and Service. For more information regarding how Google collects, uses, and shares your information and how to opt out of certain uses please visit http://www.google.com/policies/privacy/partners/. By using the Site, you consent to the processing of data about you by Google as described here and in Google's privacy policy.

We may partner with other third parties to provide certain features on our website or to display advertising on our website based upon your online activities. Some of these third parties may provide you with ways to choose not to have your information collected or used for targeted advertising. To learn more about cookies and your ability to opt-out of certain third-party advertising cookies, please visit the following websites: http://www.aboutads.info/choices or http://www.networkadvertising.org/choices. You may also have the ability to accept or decline cookies using your web browser settings. If you choose to not accept cookies from our Site, you may not be able to take full advantage of our features or to receive some of the Services that our Site provides. 

If you do not want any information to be collected and used by third-party tracking technologies, you can exercise some choice over such tracking by visiting the Network Advertising Initiative (“NAI”) Opt-Out Tool (http://optout.networkadvertising.org ) or the Digital Advertising Alliance (“DAA”) Opt-Out Tool (https://optout.aboutads.info ). Even if you disable tracking, keep in mind that you may still receive interest-based advertising, including from third parties with whom your information had been previously disclosed or advertising from third parties that is not based on your interests and preferences. 

For the mobile app, you can learn more about which third parties have currently enabled cookies for your mobile device and how to opt-out of some of those cookies by accessing the NAI’s website at http://www.networkadvertising.org/mobile-choices from your mobile device. On your mobile device you may also select “Limit Ad Tracking” (on iOS devices) or “Opt out of Interest-Based Ads” (on Android).

This Site does not respond to browser “Do Not Track” signals.

Notice regarding the U.S. Children's Online Privacy Protection Act (COPPA) 

The Children's Online Privacy Protection Act (COPPA) provides safeguards to protect children who use the Internet by regulating the online collection of Personal Information from children under the age of 13. We do not allow minors  to register for or use the Service. The Service and the Site do not target minors as an audience or a market. If you use the Service or the Site, you represent and warrant that you are the age of majority in the state in which you reside. If we learn that we have inadvertently collected Personal Information from a minor, we will make all reasonable efforts to delete that data from our records.

Security of Your Information

We take steps to ensure that your information (including credit card and bank account data) is treated securely and in accordance with this Privacy Policy by implementing reasonable security procedures and practices appropriate to the nature of the Personal Information and to protect the Personal Information from unauthorized or illegal access, destruction, use, modification, or disclosure. Unfortunately, the Internet cannot be guaranteed to be 100% secure, and we cannot ensure or warrant the security of any information you provide to us. We do not accept liability for unintentional disclosure.

By using the Service or providing Personal Information and Sensitive Personal Information to us, you agree that we may communicate with you electronically regarding security, privacy, and administrative issues relating to your use of the Service. If we learn of a security system's breach, we may attempt to notify you electronically by posting a notice on the Service or sending an email to you. You may have a legal right to receive this notice in writing. 

Changes to Our Policy and Practices

Tally reserves the right to modify this Privacy Policy at any time. Please review it whenever you use our Service to ensure you are aware of our current practices. Your use of the Service after an update to the Privacy Policy means that you accept the new policy. Unless we notify you otherwise, changes go into effect as soon as they are posted to the Site, as indicated by the “”Rev.” date at the beginning of this Privacy Policy.

For California Consumers

This California Consumer Privacy Act (“CCPA”) disclosure explains how Tally collects, uses, and discloses certain types of Personal Information or information relating to California residents. If you are a California user of the Service (“California Consumer”), you have certain rights with respect to the collection, use, transfer, and processing of your Personal Information, as described in the CCPA. We reserve the right to limit these rights where permitted under applicable law, including instances where your identity cannot be reasonably verified or to the extent your rights adversely affect the rights and freedoms of others. Under the CCPA, Personal Information is information that identifies, relates to, or could reasonably be linked directly or indirectly with a particular California resident. The CCPA, however, does not apply to certain information, such as Personal Information collected, processed, sold, or disclosed subject to the Gramm-Leach-Bliley Act. 

When California Consumers access the Site or use the Service we may collect the following categories of Personal Information, although we may not collect all of these categories, depending on which parts of the Service you use:

We may have collected these pieces of information about you depending on your use of the Service during the last 12 months.

We have collected these pieces of personal information about you from the following categories of sources:

We disclose the categories of Personal Information above for a range of operational purposes, including: 

  • To conduct identity verification; 

  • To detect and prevent fraud or abuse; 

  • To operate and maintain the Service and your account; 

  • To provide personalized content and marketing materials; 

  • To perform internal research and development; 

  • To process user inquiries and requests; 

  • To comply with laws, regulations or exercise and defend claims;

  • To perform accounting, audits, and other internal functions; 

  • For business purposes such as: 

    • Auditing related to counting ad impressions to unique visitors, verifying positioning and quality of ad impressions, and auditing compliance with CCPA and other standards;

    • Helping to ensure security and integrity to the extent the use of the California Consumers’ Personal Information is reasonably necessary and proportionate for these purposes;

    • Debugging to identify and repair errors that impair existing intended functionality;

    • Short-term, transient use, including, but not limited to, nonpersonalized advertising shown as part of a California Consumer’s current interaction with Tally, provided that the California Consumer’s Personal Information is not disclosed to another third party and is not used to build a profile about the California Consumer or otherwise alter the California Consumer’s experience outside the current interaction with Tally;

    • Performing services on behalf of Tally, including maintaining or servicing accounts, providing customer service, processing, or fulfilling orders and transactions, verifying customer information, processing payments, providing financing, providing analytic services, providing storage, or providing similar services on behalf of Tally; 

    • Providing advertising and marketing services, except for cross-context behavioral advertising, to California Consumers provided that, for the purpose of advertising and marketing, a service provider or contractor shall not combine the Personal Information of opted-out California Consumers that the service provider or contractor receives from, or on behalf of, Tally with Personal Information that the service provider or contractor receives from, or on behalf of, another person or persons or collects from its own interaction with consumers; 

    • Undertaking internal research for technological development and demonstration; 

    • Undertaking activities to verify or maintain the quality or safety of a service or device that is owned, manufactured, manufactured for, or controlled by Tally, and to improve, upgrade, or enhance the service or device that is owned, manufactured, manufactured for, or controlled by Tally; or 

  • For commercial purposes meant to advance a person’s commercial or economic interests, such as by inducing another person to buy, rent, lease, join, subscribe to, provide, or exchange products, goods, property, information, or services, or enabling or effecting, directly or indirectly, a commercial transaction; or 

  • To conduct any other legitimate business activities not otherwise prohibited by applicable law.

Third Parties with whom Personal Information is Shared

We share some Personal Information with service providers, advertisers, business partners, and law enforcement (if necessary).

In the preceding 12 months, we have not sold Personal Information (including Sensitive Personal Information) about consumers.

In the preceding 12 months we have not sold Personal Information (including Sensitive Personal Information) about minors.

Retention of your Information

We store Personal Information for as long as you use our Service, or as necessary to fulfill the purpose for which it was collected, provide our Service, resolve disputes, exercise or establish legal claims, conduct audits, pursue legitimate business purposes, enforce our agreements, comply with applicable laws, or when we have any other business need for such information. 

Exercising Your California Privacy Rights

  • Right to Know: You have the right to request that we disclose, free of charge, what Personal Information, including Sensitive Personal Information, we collect, use, disclose and sell during the preceding 12 months. This includes:

    • The categories of Personal Information we’ve collected about you; 

    • The categories of sources from which the Personal Information is collected; 

    • The business or commercial purpose for collecting your Personal Information; 

    • The categories of third parties we have shared Personal Information with; and

    • The specific pieces of Personal Information we have collected.  

  • Right to Know:You have the right to request that we disclose, free of charge, what Personal Information, including Sensitive Personal Information, we have disclosed for a business purpose. 

  • Right to Delete: You have the right to request that we delete Personal Information, including Sensitive personal information we have collected from you (and direct our service providers to do the same). 

  • Right to Opt-Out of Sale: Tally does not sell Personal Information or Sensitive Personal Information. 

  • Right to Opt-Out of Sharing: You have the right to opt-out of the sharing of your Personal Information (and direct our service providers to do the same).

  • Right to Limit Use and Disclosure of Sensitive Personal Information: You have the right to limit our use and disclosure of your Sensitive Personal Information to that which is necessary to perform our Services.  

  • Right to Correct: You have the right to correct any inaccurate information we have maintained about you.

  • Other Rights: You have the right to designate an authorized agent to make a request for you under the CCPA on your behalf. We may request proof of authorization and identity documentation from the authorized agent. Your authorized agent may submit a request here. You also have the right not to be discriminated against for exercising any of the rights listed above. 

  • Verification: To process your request, our team may require identity verification. In some instances we may decline to honor your request where an exception under law applies.
